PERSONAL DATA PROTECTION POLICY

SIAM KUBOTA CORPORATION CO., LTD., having its office located at: No. 101/19-24, Moo 20, Navanakorn Industrial Estate, Klong Nueng Sub-district, Klong Luang District, Pathumthani Province, Thailand (“Company”), executes this Personal Data Protection Policy (“Policy”) to comply with our obligations under the Personal Data Protection Act B.E. 2562 (2019) and the rules, regulations, notifications and/or directives issued by virtue thereof, as may be amended from time to time (collectively referred to as the “PDPA”), to inform you about the details relating to the collection, use, disclosure and otherwise processing (collectively referred to as the “processing”) of the Personal Data which you have provided to the Company, whether in a hard copy or electronic format. The Company may receive your Personal Data directly from you via the Company’s website or application, social media such as Facebook, etc., and/or other channels.
Personal Data means data which enables the identification of an individual or which can be linked to such individual, whether directly or indirectly. When you register to receive marketing information and/or products and services information, the Company will process your following categories of Personal Data: name, surname, email address, phone number, user account for WhatApp or any other similar application used for sending/receiving text, name of the business enterprise, and country of residence. In the event that you agree to be the Company’s seller or distributor of the products (“Distributor”), the Company may process additional categories of your Personal Data which are: position, facsimile number, other contact details, date of birth, age, nationality, passport number, and other categories of Personal Data as may appear on the copy of your passport, signature, photograph, technical data such as IP Address, cookies, location and mobile device which you are using, etc. Sometimes, the Company may collect your Personal Data from third parties, including a social media platform service provider, such as Facebook or another platform service provider, etc.
Purposes for the Processing of Personal Data: The Company processes your Personal Data for the following purposes: (a) contact and communication in order to provide you with information and details about the Company’s products and services, to enable you to make a determination in relation to being the Distributor of the Company; (b) to undertake any acts which are relevant and necessary for entering into a distributorship agreement with you, including, without limitation, to verify your identity; (c) to entering into the distributorship agreement with you, and to perform any obligations of the Company under said agreement; (d) to provide any advice, consultations, support and assistances in relation to the selling of the Company’s products and services; (e) to send information, materials, marketing promotional information, and marketing offers in relation to the Company’s products and services to you; (f) to comply with the laws, rules, regulations, court orders, orders of the competent authorities and/or supervisory authorities which are applicable to the Company, including, without limitation, the PDPA; and (g) to undertake any acts which are necessary and relevant for the prevention of fraud or the commission of criminal offences. Please be informed that if you did not provide your Personal Data ,when such Personal Data is required for the purpose of entering into the agreement and/or the performance of the agreement, this may result in the Company being unable to enter into the agreement with you, or perform obligations under the agreement between the Company and you. Furthermore, if you did not provide your Personal Data when such Personal Data is required for the purpose of complying with legal obligation, it may be deemed that the Company and/or you have acted in violation or non-compliance with the law.
Disclosure of Personal Data: The Company may disclose your Personal Data to third parties, which include the Company’s affiliates and group companies which are located anywhere in the world, and the Company’s service providers such as accounting service providers, auditors, information technology service providers and legal advisors, in order to carry out any acts which are relevant to the processing of Personal Data for the purposes described above. The Company will undertake necessary actions to ensure that the third parties or the legal entities stated above, which are located overseas, will implement adequate personal data protection measures, as prescribed by the PDPA. In addition, the Company may disclose your Personal Data to government agencies, courts, and competent authorities.
Retention Period: If you did not agree to enter into the distributorship agreement with the Company, the Company will retain your Personal Data for a period of 12 months from the date of our last contact. If you agree to enter into the distributorship agreement with the Company, the Company will retain your Personal Data throughout the period of our relationship, and will continue to retain such Personal Data for a period of 10 years after the end of our relationship, unless otherwise permitted or stipulated by law.
Your Rights under the Personal Data Protection Law: You are entitled to the following rights: (1) to withdraw consent at any time, where the processing of your Personal Data is based on consent. Your withdrawal of consent will not affect the processing of your Personal Data for which you have lawfully granted consent prior to such withdrawal; (2) to request the Company to delete, destroy, or de-identify the Personal Data; (3) to receive or request that the Company transfer your Personal Data in a format, which is generally readable or usable by automatic machines, to other data controllers (if any); (4) to object to the processing of your Personal Data; (5) to request that the Company suspend the processing of your Personal Data; (6) to request to have access and/or obtain a copy of your Personal Data; (7) to request the Company to disclose the obtaining source of your Personal Data in the event that you do not grant consent to the Company; (8) to request that the Company undertake actions to rectify, correct and update your Personal Data; (9) to file complaint to the personal data protection supervisory regulator, if you opine that the Company did not comply with the PDPA. The exercise of any of your rights to your Personal Data is subject to the conditions and restrictions imposed by the PDPA.
